Interlibrary Loan Agreement
Nylink
This Code is a voluntary agreement to govern all interlibrary lending among libraries in the Nylink Network. It is intended to promote a more liberal interlibrary loan policy among the libraries adopting it than that of the ALA National Interlibrary Loan Code. This code is based on the premise that lending among libraries for the use of an individual is in the public interest and should be encouraged.
I. Definition
Interlibrary loans are transactions in which library materials or copies of library materials are made available by one library to another upon request.
II. Scope
Under the terms of this agreement, any type of library material may be requested on loan or in photocopy from another library. The lending library retains the right of deciding in each case whether a particular item should or should not be provided, and whether the original or a copy should be sent.
III. Responsibility of Borrowing Libraries
A. It is recognized that interlibrary lending does not relieve any library of the responsibility of developing its own collection. Each library should provide the resources to meet the ordinary study, educational, instructional, informational and research needs of its users. No library should depend upon another to supply the recurring needs of its clients.
B. Participants in this agreement, where feasible and cost effective, should follow local, regional or state cooperative resource sharing agreements, taking care to avoid concentrating the burden of requests on a few libraries. Local resources should be exhausted before going to other members.
C. The borrowing library is responsible for compliance with the copyright law (Title 17, U.S. Code) and its accompanying guidelines, and should inform its users of the applicability of the law. An indication of compliance must be provided with all copy requests.
D. The safety of borrowed material is the responsibility of the borrowing library from the time the material leaves the lending library until it is returned to the lending library. The borrowing library is responsible for packaging the material so as to insure its return in good condition. If damage or loss occurs, the borrowing library must meet all costs of repair or replacement, in accordance with the preference of the lending library.
E. The borrowing library and its users must comply with the conditions of loan established by the lending library. All material on loan is subject to immediate recall, and the borrowing library shall comply promptly.
F. The borrowing library agreeing to abide by this code should place "@/S" in the affiliations field of the interlibrary loan form. If the lender string contains some non-signers be sure to also include the maximum cost you are willing to pay for the material.
IV. Responsibility of Lending Libraries
A. The decision to loan material is at the discretion of the lending library. Nylink members are encouraged, however, to interpret as generously as possible their own lending policy with due consideration to the interest of their primary clientele.
B. A statement of interlibrary loan policy and charges will be provided to other libraries either online or in writing upon request. This statement should be reviewed annually.
C. A lending library is responsible for informing any borrowing library of its apparent failure to follow the provision of this code.
D. A lending library will not require information about the status of the individual for whom material is being requested.
E. All signers agree to act as "Suppliers" within the OCLC/ILL Subsystem.
V. Expenses
A. Nylink member libraries who sign this agreement will not charge each other for the following:
- Fees for handling interlibrary loan requests
- Postage or other transportation charges exclusive of telefacsimile
- Photocopying (up to 33 pages per request)
- Insurance
B. The borrowing library should be prepared to assume costs for lost and damaged materials and any other costs not excluded by this code.
VI. Violation of the Code
Each library is responsible for maintaining the provisions of this code in good faith.
VII. Withdrawal from the Code
If the participating library wishes to withdrawal from this agreement, a statement in writing to that effect should be submitted to the Nylink 30 days prior to the anticipated date of withdrawal.
